In 2015, the legislature, courts and regulatory agencies have kept employers guessing, with new legal developments covering many unexpected topics. If ever there was a time to update your personnel manual, this is it. We have lots to discuss, with many new laws, case developments, and regulatory actions affecting your business. Among the topics to discuss:
- 2015 Oregon Legislative Update: A review of the bills that passed this session, and what these new laws mean for employers. We will take a closer look at significant legislation related to: statewide mandatory sick leave; social media protections; wage discussion protections; updates to the Oregon Family Leave Act; criminal background inquiries; and new limits on non-competition agreements.
- Case Law Update: We will review recent case law developments at the federal and state court level, including good news for employers regarding payment for time at the beginning and end of work shifts; new developments in pregnancy discrimination protections; enforceability of non-competition agreements; and employer accommodations of religious practices.
- Recreational Marijuana Update: We will review what legalization means for your workplace, and what you can and should be doing to ensure a drug-free workplace.
- Proposed Regulatory Changes: The Department of Labor is likely to update its rules on classification of exempt employees. The new rule is likely to result in mandatory payment of overtime for many employees who are currently classified as exempt. We will also talk about new regulatory developments under the FMLA.
- Time to Update Your Personnel Manual: We will talk about updates that employers ought to make to their personnel manuals to address these many legal developments.
